Welcome to SkinEat AI! These Terms and Conditions ("Terms") govern your use of our mobile application ("App"). By using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Acceptance of Terms

By accessing and using the App, you accept and agree to be bound by these Terms. We may update these Terms from time to time, so please review them periodically. Your continued use of the App after such changes constitutes your acceptance of the updated Terms.

2. Use of the App

• Eligibility: You must meet the age and legal capacity requirements outlined in Section 6.
• Personal Use: The App is intended for your personal, non-commercial use. You may not use the App for any commercial purpose without our prior written consent.
• User Conduct: You agree not to use the App in any way that is unlawful, harmful, or otherwise objectionable, including but not limited to:
  • Violating any applicable laws or regulations.
  • Infringing the rights of any third party.
  • Uploading viruses or any other harmful computer code.
  • Attempting to gain unauthorized access to the App or its related systems or networks.
  • Interfering with or disrupting the App or servers connected to the App.
  • Using the App in any manner that could damage, disable, overburden, or impair our servers or networks.

3. User Content

• Meal Photos: The App allows you to upload images of your meals to generate skin-focused insights. These images are processed using AI technology and stored to maintain your food journal and historical insights. You retain all rights to the images you upload.
• Profile Information: You may provide information about your skin type, eating habits, sleep quality, and cycle timing (optional) to personalize your experience. You are responsible for the accuracy of this information.
• Responsibility: You are solely responsible for the content you upload to the App. You agree not to upload any content that is illegal, harmful, offensive, or violates the rights of any third party. You represent and warrant that you have all necessary rights to upload any content you submit to the App.
• License to Use: By uploading content to the App, you grant us a limited, non-exclusive, royalty-free license to use, store, and process your content solely for the purpose of providing and improving the App's services.

4. Intellectual Property

• Ownership: All rights, title, and interest in and to the App, including all intellectual property rights, are owned by SkinEat AI. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.
• Restrictions: You agree not to:
  • Modify, copy, or create derivative works based on the App.
  • Distribute, transfer, sublicense, lease, lend, or rent the App to any third party.
  • Reverse engineer, decompile, or disassemble the App.
  • Remove, alter, or obscure any proprietary notices, labels, or marks on the App.
  • Use the App in any unlawful manner or in a way that violates these Terms.
• Trademarks: "SkinEat AI" and related logos are trademarks of SkinEat AI. You may not use these trademarks without our prior written permission.

5. Privacy

Your use of the App is also governed by our Privacy Policy. By using the App, you consent to the collection, use, and disclosure of your information as described in the Privacy Policy. Please review our Privacy Policy carefully to understand our practices.

6. Age and Legal Capacity

To use SkinEat AI, you must:

• Be at least 13 years old.
• If you are under the age of 18, you may only use SkinEat AI with parental consent as required by your country's laws.
• Have the legal capacity to enter into binding agreements in your jurisdiction.

7. Medical Disclaimer and No Medical Advice

Important: The information, insights, recommendations, and analysis provided by SkinEat AI, including Glow Scores, hydration indicators, inflammation scores, breakout risk assessments, and daily insights, are strictly for informational and educational purposes only. They are not intended as a substitute for professional medical advice, diagnosis, or treatment.

SkinEat AI does not provide medical advice. The App may produce suggestions, insights, or recommendations based on AI algorithms and general nutritional information, but these are not personalized medical advice. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding:

• A medical condition or skin condition.
• Dietary changes or nutritional needs.
• Any health-related concerns.

Never disregard professional medical advice or delay in seeking it because of something you have read or learned through the App.

We are not responsible for the correctness, accuracy, completeness, or reliability of any content, insights, or recommendations generated by SkinEat AI. All actions you take based on the App's analysis are made independently by you, and we assume no liability for your decisions or any health outcomes.

8. AI Technology and Accuracy

SkinEat AI uses artificial intelligence and machine learning technologies to analyze meal photos and provide insights. While we strive for accuracy, AI technology is not perfect and may produce errors or inaccurate results. The App's analysis is based on algorithmic processing and general nutritional data, and individual results may vary. We do not guarantee the accuracy, completeness, or reliability of any analysis or insights provided by the App.

9. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including, without limitation, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted or error-free, that defects will be corrected, or that the App is free of viruses or other harmful components. Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.

10. Limitation of Liability

To the fullest extent permitted by applicable law, SkinEat AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use the App.
• Any unauthorized access to or use of our servers and/or any personal information stored therein.
• Any interruption or cessation of transmission to or from the App.
• Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the App by any third party.
• Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, transmitted, or otherwise made available through the App.
• Any health-related outcomes or decisions made based on the App's insights or recommendations.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you.

11. Account Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause or notice, for any reason, including but not limited to a breach of these Terms. You may also delete your account at any time through the App settings. Upon termination, your right to use the App will immediately cease, and we may delete your account and all associated data, subject to our Privacy Policy and applicable law.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of your jurisdiction, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms or the App shall be resolved through binding arbitration or in a court of competent jurisdiction, as applicable in your jurisdiction.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.
